This Privacy Policy applies to the collection, use, disclosure and handling of personal information by Intuent Solutions Pty Ltd ACN 644 158 663 trading as MotorPlatform and its associated entities (collectively MotorPlatform, we or us), including personal information collected via our www.motorplatform.com.au website (the Website), and mobile app MotorIntel (Mobile App).

MotorPlatform is committed to protecting the privacy of individuals and is bound by the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (the Act). This Privacy policy outlines how we will collect, use, disclose and otherwise handle person information as defined in the Act.

The personal information we collect may include (but may not be limited to) account information such as your name, contact details, date of birth, gender, email address and phone number, Internet Protocol (IP) address, device information, occupation, payment details, images of you and other information relating to your dealings with us.

We also collect personal information from you where it is relevant to us providing goods or services to you. This may include information processed and collected by third party providers that are necessary for us to provide our goods and services to you.

The purposes for which we collect your information include:
(a) providing you with our goods or services;
(b) contacting you about our goods and services to you (see section 7);
(c) developing and improving our goods and services (including through AI, data analytics and machine learning) and obtaining feedback including surveys;
(d) for our internal business and marketing purposes and those of our related bodies corporate; and
(e) contacting you (including via electronic messaging such as SMS and email, by mail, by phone or in any other lawful manner).

We also collect vehicle valuation information from users through our Website and our MobileApp. This information is not linked or associated with your personal information and is only used to develop and improve our goods and services.

If we are not able to collect personal information about you we may not be able to provide you with products, services and assistance to the extent that they require us to collect, use or disclose personal information.

MotorPlatform collects personal information from you in a number of different way. We may collect personal information directly from you or in the course of our dealings with you, for example when you:
(a) provide personal information to us;
(b) browse or use our Website (including via cookies and other tracking technologies);
(c) use our goods or services on our Website or Mobile App (including content uploaded by you to our Mobile App);
(d) pay for our goods or services; or
(e) contact and correspond with us, for example to ask for information.

We may also collect personal information about you from another MotorPlatform group entity, publicly available sources, or in some cases, from third parties including:
(i) the third party services used by us to process payments and collect payment information; and
(ii) third party services used to provide you with information and respond to your enquiries.
5.1
We receive and store certain types of information automatically, such as whenever you interact with the Website or Mobile App (including metadata from images you may upload to the Website or Mobile App). This information does not necessarily reveal your identity directly but may include information about the specific device you are using, such as the hardware model, device ID, operating system version, web-browser software (such as Firefox, Safari, or Internet Explorer) and your Internet Protocol (IP) address/MAC address/device identifier.
5.2
When you visit our website, our web servers gather your IP address to assist with the diagnosis of problems and to enable us to provide the best level of service.
5.3
We use cookies on our website to provide you with a better experience. “Cookies” are a small piece of data sent from a website and stored in a user’s web browser while the user is browsing that website. Every time the user loads the website, the browser sends the cookie back to the server to notify the website of the user’s previous activity. These cookies allow us improve your security and experience, and improve our site. This data is generally aggregated and provided to us to assist in analysing the usage of the site.

We treat information collected by cookies and other similar technologies as non-personal information unless:
(a) applicable laws require us to treat them as personal information; and
(b) to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.

MotorPlatform may use or disclose your personal information for the purpose for which it was collected. We will also use and disclose your personal information for a secondary purpose that is related to a purpose for which we collected it, where you would reasonably expect us to use or disclose your personal information for that secondary purpose.

Other instances when we may use and disclose your personal information include:
(i) where you have expressly or impliedly consented to the use or disclosure;
(ii) in confidence, to our advisers and insurers;
(iii) in confidence, to third parties to improve our services and obtain feedback; and
(iv) where the use or disclosure is authorised or required by or under an Australian law or court/tribunal order.

We may also disclose your personal information to third parties, including:
(i) amongst other MotorPlatform group entities and platforms, where applicable;
(ii) to other Website and Mobile App users where you consent to such disclosure;
(iii) with our advisors and consultants;
(iv) third parties necessary to provide our goods and services to you (including disclosure to the network of dealerships that provide valuations on our Mobile App and third party payment platforms); and
(v) with third party service providers we use in conducting our business, subject to confidentiality provisions as we deem appropriate (including, without limitation, billing or data storage services, email filtering, virus scanning and other technology services providers, and archival services providers).

We may contact you via email, SMS or other means in order to provide you with updated information about the services we provide or to provide you with other information about our goods and services. If you do not wish to receive any such information, please contact us to opt out as set out below.
8.1
We provide links to third party websites. These linked sites are not under our control, and we cannot accept responsibility for the conduct of companies linked to our Website. Before disclosing your personal information on any other website, we advise you to examine the terms and conditions of using that website and its privacy statement.

You have a right to request access to, or correction of, your personal information held by us.If you wish to access, correct or update any personal information we may hold about you, please contact us as set out in section 13 below. However, we may charge for providing access to this information and we may refuse access where the Act allows us to do so.
9.2
If we refuse to correct your Personal Information, or provide access as requested, we must notify you in writing of the reasons for refusal (unless it is unreasonable for us to do so); and the mechanisms available for you to complain about the refusal.

If you have any questions or concerns about our collection, use or disclosure of personal information, or if you believe that we have not complied with this Privacy Policy or breached the Australian Privacy Principles, please contact us as set out in section 13 below. When contacting us, please provide as much detail as possible in relation to the query, issue or complaint.

A complaint should first be made in writing to MotorPlatform. Your complaint will be taken seriously and will be assessed by an appropriate person with the aim of resolving any issue in a timely and efficient manner. We request that you cooperate with us during this process and provide us with relevant information we may require.

You can also complain to the Office of the Australian Information Commissioner (the OAIC).
The Act requires your complaint to the OAIC be in writing by:
(a) online privacy complaint form;
(b) downloaded privacy complaint form;
(c) email.

11.1
We host and store our customer data electronically in our IT systems.
These may include Australian and internationally-based cloud servers
or the servers of third parties within and outside of Australia.
11.2
MotorPlatform will take reasonable steps to keep any personal information we hold about you secure and ensure that internationally-based parties comply with the Act. However, except to the extent liability cannot be excluded due to the operation of statute, we exclude all liability (including in negligence) for the consequences of any unauthorised access to your personal information. Please notify us immediately if you become aware of any breach of security.
11.3
If we no longer require your personal information for the purposes it was obtained we will take reasonable steps to destroy or de-identify the information we hold about you, unless it is information contained in a Commonwealth record or we are required by law, or a court, to retain the information.

The date of this Privacy Policy is set out at the top of page 1. We may change this Privacy Policy at our discretion. Any changes to this Privacy Policy will be posted on our Website at motorplatform.com.au/privacy-policy. Unless states otherwise, changes will be effective immediately upon being placed on the website.

By continuing to use the Website, or otherwise continuing to deal with us, you accept this Privacy Policy as it applies from time to time.
